WAIVER AND RELEASE
In consideration of my participation at the “Peroni Portal” event in New York, New York on July 24, 2026 (the "Event") and goodwill and publicity, the receipt and sufficiency which are hereby acknowledged, I hereby agree as follows:
I. Representations and Warranties of Participant; Release of Liability.
I represent and warrant that I have fully informed myself of all details of participating in the Event and related activities. I acknowledge that the consumption of alcoholic beverages at the Event is entirely voluntary and I agree that I will drink responsibly, will not drink the alcoholic beverage provided outside of the Event venue, and will not operate a motor vehicle or engage in any dangerous activity while impaired. I understand and voluntarily assume the full risks associated with consuming alcohol, including impaired judgment, coordination and reaction time, illness, injury and property damage.
To the fullest extent permitted by applicable law, I hereby fully, forever and irrevocably release, waive, discharge, and indemnify and hold harmless the Released Parties (as defined below) from any and all liability, losses, damages, rights, claims and actions, of any kind, in whole or in part, directly or indirectly, arising from or relating to the Event and/or my attendance or participation in any Event-related activity (including my voluntary consumption of alcohol or my acts or omissions while impaired), including without limitation, personal injury, death and/or property damage.
II. Release of Likeness.
I grant to Molson Coors Beverage Company USA, LLC ("MCBC"), Mischief@NoFixedAddress Inc., and each of their representatives, agencies, vendors and subcontractors, and each of their subsidiaries, affiliates, employees, representatives, agents, vendors, subcontractors, representatives and assigns (collectively, "Released Parties") the absolute and unlimited right and permission to copyright and/or use/reuse, publish, republish and otherwise reproduce, modify and distribute, in their sole discretion, any video and audio recordings, footage and images of me and my performance, voice, name, and likeness taken at the Event (collectively, Likeness") any mediums in all media known now or in the future on a worldwide basis in perpetuity, including but not limited to, broadcast, print, consumer trade, OOH, POP, retail, internet digital (including social media), mobile, apps, industrial, collateral and marketing and award purposes, in accordance with the terms of this Waiver and Release (the "Release"). My Likeness may, intentionally or otherwise, be blurred, altered, distorted in character, or form, used in composite form, in optical illusion, in conjunction with my own or a fictitious name, on reproductions thereof in color, or black and white, made through any media, for any purpose whatsoever, including the use of any printed matter in conjunction herewith.
I hereby release and discharge any and all present and future claims for any liability hereunder (including, but not limited to, claims of copyright infringement, defamation, disparagement, slander, false light, and invasion of privacy or rights of publicity), and agree to hold harmless the Released Parties or any person or persons, corporation or corporations, for whom they might be acting, including any company publishing and/or distributing the finished product, in whole or in part, from and against any liability or any compensation as a result of my Likeness being filmed, photographed or recorded in connection with the Event (the "Materials").
I hereby waive any right to inspect or approve the Materials or advertising copy or printed matter that may be used in conjunction therewith or the eventual use that it might be applied, and further acknowledge and agrees that the Released Parties shall have no obligation to compensate me in connection with the use of the Materials.
I agree and acknowledge that MCBC is the owner of the Materials, the copyrights pertaining thereto and any and all other rights, benefits or privileges arising there from, now and hereafter without limitation, and that I have no rights of any kind in or to the Materials, including but not limited to, the right to use the Materials for self–promotional purposes or other social media purposes.
III. Miscellaneous
I hereby warrant that (a) I am over twenty-one (21) years of age and competent to contract in my own name in so far as the above is concerned; and (b) I have never been charged with a criminal offence in The United States of America or in any other country; (c) the execution of this Release will not cause violate any third party rights.
This Release shall be governed by the laws of the State of New York notwithstanding its conflict of laws principles, with venue in New York County, New York. This Release is the complete and exclusive statement of the agreement between the parties with respect to the subject matter hereof and may not be modified except by a writing signed by both parties. This Release is severable should any provision be deemed void or unenforceable. This Release is binding upon my agents, heirs, successors, assigns and representatives. Any provision which must survive to give effect to its meaning shall survive the expiration or termination of this Release. My signature below, acceptance through a clickwrap agreement, signature through an electronic signature solution (e.g. DocuSign or Adobe) or other electronic or manual/written acknowledgement of these terms will be fully binding on me.
I have read the foregoing Release and warrant that I fully understand the contents thereof.
